How The Supreme Court’s Decision
Affects California’s Local Governments
The Senate Local Government Committee has just published the results of its August 17, 2005 hearing. Five experienced attorneys advised the legislators on property rights and public agencies.
The new report contains four findings by the Committee’s staff:
- Who’s affected? None of the witnesses said that Kelo affected counties, cities, special districts, or school districts. They focused on redevelopment agencies.
- California effects. The witnesses disagreed on how Kelo affected redevelopment agencies’ eminent domain powers.
- Eminent domain procedures. The witnesses disagreed over property owners’ protections under the existing statutory procedures.
- The “blight” definition. Senator Kehoe announced that the “blight” definition would be a subject of her Committee’s fall interim hearings.
The Committee’s report includes a nine-page summary of the witnesses’ remarks, a staff background paper, and copies of the witnesses’ extensive written materials.
